What’s happening is this:

On Tuesday, the U.S. Equal Employment Opportunity Commission sued BMW arguing its criminal background checks on workers at a South Carolina plant became discriminatory when the company refused to rehire any employees with convictions on their records. Some employers argue the government is trying to force BMW to hire convicted criminals – and calling them racist when they don’t. Is this the case?

Not exactly, says Derek Smith, a New York City employment lawyer. Smith says it boils down to a concept called “disparate impact,” where an employer practice “may be discriminatory and illegal if it has a disproportionate adverse impact on members of a protected class.”

Thirty-some years ago, I first read The Turner Diaries, and the scenario it begins with struck me then as fascinating futuristic fiction by a very pessimistic White Supremacist. The judges were never going to be all Jewish, nor was the government ever going to make it almost criminal to be a White person. And why would the government PROTECT black criminals? Not badly written, I thought, but a little ridiculous.

Well, people like me are eating crow hand over fist these days. The logic of this EEOC lawsuit is something straight out of TTD. 

To wit:

Human Being Version of Recruitment

1. Companies wish to avoid hiring employees who may potentially hurt their profit margin

2.  People with criminal backgrounds are statistically more likely to recommit crimes and/or to have personality issues making them the sorts of employees that hurt the profit margin

3. ERGO, companies check personal histories and avoid hiring people with criminal backgrounds; co-workers are safer and so is the employer.

 

EEOC Version of Recruitment

1. Companies wish to avoid hiring employees who may potentially hurt their profit margin

2.  People with criminal backgrounds are statistically more likely to recommit crimes and/or to have personality issues making them the sorts of employees that hurt the profit margin

2a. BLACKS are statistically more likely to have criminal backgrounds, especially felonies

3. ERGO, companies check personal histories and avoid hiring people with criminal backgrounds; co-workers are safer and so is the employer.

3a. And we sue they asses for trying to keep our young mens out! Ebberyboddy know dat da justiss system is rayciss’ and sheeit! You bettah jus’ hire and not axe no questions, Cracka muthafuckas! Gibsmedat settlement, beeatch! Safer my black ass.

Predictably, little has been said about it. As the book says:

“As long as the government is able to keep the economy somehow gasping and wheezing along, the people can be conditioned to accept any outrage.”

    As Peter Schiff pointed out, this means that companies will be even more reluctant to hire blacks. If you hire someone who commits a crime at your place of employment, you can be sued. So they are basically making it impossible for business to do business in the USA.

    I know a Chinese woman who owns a restaurant in Atlanta. She told me her cousin is in business in Shanghai getting jobs outsourced from America to China.

    In the course of our conversation she laughingly pointed out that every hiring decision in America is a potential bankruptcy for the company doing the hiring.

    “Did not hire because Hispanic. Did not hire because woman, Did not hire because homosexual. Did not hire because straight. Did not hire because Black. Did not hire because old….”

    Juries are allowed to award unlimited damages if an applicant or an employee sues the company for racial, sexual, national origin, age or other categories that enjoy special protection under the Civil Rights Laws.

    As the Chinese woman pointed out, every time her cousin gets an American company hires a Chinese there’s no danger of being sued and ruined.

    “No Tibetan homosexual ever sue China business and have jury of Tibetan homosexuals give business away.”

    American business has bent over backwards not to discriminate against the scheduled castes. Everybody knows that. This not only results in the qualified White males being subjected to brutal discrimination. It also forces businesses to keep on the rolls unqualified or marginally unqualified employees.

    Setting aside all other reasons for the continued decline of America’s economic standing in the world, the Civil Rights Laws – alone – guarantee that American business cannot compete in a global market.
